Independent Legal Advice (ILA) in BC
Someone has asked you to get independent legal advice before you sign. It is a short, separate meeting where a lawyer who is not on the other side confirms you understand the document and are signing freely.
A lender, a family member, or the other side of an agreement has told you to get independent legal advice, often called ILA. It can feel like a hurdle when you just want to sign and move on. It is actually there to protect you. ILA means you sit down with a lawyer who has no stake in the deal and no connection to the other party, so the advice you get is only about your interests.
In British Columbia, ILA is a short meeting on its own, separate from the rest of the transaction. We read the document with you, explain what it means in plain language, answer your questions, and confirm you are signing on your own, without pressure from anyone. When we are satisfied that you understand it and are signing freely, we provide a signed certificate that says so. That certificate is often what the lender or the other side needs before the deal can close.

Common questions
What actually happens in an ILA meeting?
It is a short meeting on its own, separate from the rest of your transaction. When we are satisfied, we provide a signed certificate saying we gave you independent advice. You bring that certificate, or we send it, back to whoever asked for it.
Why does the lender or the other side want me to get ILA?
So that later on, no one can say you did not understand what you signed or that you were pressured into it. A guarantee, a mortgage, or a separation agreement is much harder to challenge afterward when an independent lawyer has confirmed you understood it and signed freely. The certificate protects them, and the honest advice protects you.
Can the lawyer handling the deal also give me the advice?
No. The whole point of independent legal advice is that it comes from a lawyer who is not acting for the other party and has no interest in the deal going through. If we are giving you ILA, we are only looking after you in that meeting. That is what makes the advice, and the certificate, independent.
How long does it take and what should I bring?
An ILA meeting is usually short, often well under an hour, though a longer or more complex agreement can take more time. Bring the full document you have been asked to sign, any related paperwork the other side gave you, and government photo identification.
