In BC, when you refinance, your old mortgage has to be discharged from the title and the new one registered at the Land Title Office, and that happens in a specific order so your lender's funds are protected.

Common questions

Do I need a lawyer to refinance in BC?

Yes. To register a new mortgage and discharge the old one at the Land Title Office, the work has to be done by a lawyer or notary. Most lenders will not release refinancing funds until a lawyer or notary confirms the new mortgage is registered against your title in the priority position the lender requires.

How long does a refinance take to close?

Once we have your lender's instructions, the legal work usually takes about 7 to 10 business days, though it can vary with how quickly your current lender sends the payout statement. We start as soon as we receive the instructions so everything is ready for your funding date.

Do I pay Property Transfer Tax when I refinance?

No. Property Transfer Tax applies when property is transferred into your name, not when you refinance an existing mortgage on a property you already own. You will still have registration fees and the legal fees for the work, and we set those out for you in advance.

What is a mortgage discharge and why does it matter?

A discharge is the document that removes your paid off mortgage from your title. Until it is registered at the Land Title Office, the old lender's charge still shows against your property, which can hold up a future sale or refinance. We confirm the payout, arrange the discharge, and make sure it is registered so your title is clean.
