Real Estate Lawyers in Victoria
Property in Victoria moves fast and rarely looks the same twice. One file is a downtown condo with a thick strata package, the next is a single family home in Fairfield, an acreage out past Langford, or a waterfront lot with a dock and a septic system. Whatever you are buying or selling on Vancouver Island, every transfer in BC still has to be completed by a lawyer or notary, and the details are where a smooth closing is either protected or lost.
We act for buyers, sellers, and owners refinancing across Greater Victoria, including Saanich, Oak Bay, Esquimalt, Langford, Sidney, and the West Shore. We read your Contract of Purchase and Sale, search the title for mortgages, liens, easements, and rights of way, review the strata documents on a condo or townhouse, and prepare the transfer, mortgage, and Property Transfer Tax forms. Then we coordinate with your realtor, your lender, and the lawyer on the other side so the money moves correctly and your title registers cleanly at the Land Title Office.
Victoria draws a lot of buyers from off the Island and from out of province, so we are used to closings where the client is not in the room. We can handle signing remotely, walk you through each date and cost over the phone, and flag the things that catch people here, like the Speculation and Vacancy Tax and whether an exemption applies to you. You get plain answers, a clear list of what we need, and no surprises on completion day.
How we help in Victoria
Residential purchases
From a downtown Victoria condo to a family home in Saanich, we review your contract, search title, handle the Property Transfer Tax, and register your new place so you take clean ownership.
Strata and condo reviews
We read the strata documents, the depreciation report, and the Form B for any apartment or townhouse purchase, so you know about special levies, bylaws, and pending costs before subjects come off.
Property sales
We prepare your transfer, clear the existing mortgage, deal with the buyer's lawyer, and make sure your sale proceeds reach you correctly and on time.
Refinancing
Pulling equity from a Victoria home or moving lenders, we discharge the old mortgage, register the new one, confirm payout figures, and time the funds to avoid penalties.
Title transfers and family transactions
Adding a spouse, removing a name, or transferring an Island property within the family, prepared so the change holds up at the Land Title Office.
Out of town and remote closings
Buying in Victoria from the mainland or out of province? We arrange remote signing and keep you updated by phone and email so distance does not slow the deal.
Common questions
Do I need a lawyer to buy or sell a home in Victoria?
A property transfer in BC has to be completed by a lawyer or notary. A lawyer can also give you legal advice, sort out a title problem, and step in if the deal becomes disputed, which a notary cannot do. On a strata purchase or anything with a wrinkle in the title, that advice can matter.
What is the Property Transfer Tax and will I pay it on a Victoria purchase?
It is a tax paid when property registers in your name: 1% on the first $200,000, 2% up to $2,000,000, and 3% above that. First time buyers and some newly built homes may qualify for an exemption. With Victoria prices, the difference is real, so we confirm where you stand before closing.
I am buying in Victoria but live on the mainland or out of province. Can you still close my deal?
Yes. A lot of our Island buyers are not local. We can arrange remote signing, walk you through each step by phone and email, and coordinate with your realtor and lender so you do not need to be in Victoria on completion day.
