ICBC & Enhanced Care in Victoria

ICBC and Enhanced Care Lawyers in Victoria

A crash on the Pat Bay Highway, a rear-ender on Douglas Street, or a slow-speed collision in a Victoria parking lot can leave you sore, off work, and suddenly dealing with ICBC. Since May 1, 2021, British Columbia has used the Enhanced Care model, a no-fault system. For most crashes after that date, you do not sue the other driver for a settlement. Instead, you claim a set of benefits through ICBC to support your recovery, no matter who caused the collision.

That sounds simple, but the day-to-day reality is not. ICBC still decides which treatments it will fund, how much income replacement you receive, and when your benefits stop. Those decisions are not always right, and they often arrive when you are least able to push back. The choices you make in the first weeks, the medical records you gather, and the deadlines you meet all shape what you actually get.

We work with people across Victoria, Saanich, Langford, and the rest of Vancouver Island who are trying to make sense of an Enhanced Care claim or who have hit a wall with ICBC. We explain what you are entitled to in plain language, help you access it, and step in when a benefit is reduced, delayed, or denied. The first conversation is a free, no-obligation case evaluation, and you can reach us by phone or at our Victoria meeting office.

How we help in Victoria

  • Open and manage your Enhanced Care claim

We guide drivers, passengers, cyclists, and pedestrians hurt in a Victoria-area crash through the claim from the first report, so the file is set up correctly from the start.

  • Access your medical and rehabilitation benefits

We help you get funding for the treatment your recovery needs, from physiotherapy to specialist care, so paperwork and pre-approvals are not what holds you back.

  • Sort out income replacement

If your injuries keep you off work, we help you claim income replacement benefits and respond when ICBC questions whether you can return to your job.

  • Challenge denied or reduced benefits

When ICBC cuts off treatment, lowers a payment, or says no, we help you request an internal review and build the medical support to push back.

  • Take disputes to the Civil Resolution Tribunal

If a fair result cannot be reached with ICBC directly, we help you prepare and present your case at the Civil Resolution Tribunal, which handles many Enhanced Care disputes.

  • Check whether an exception applies to you

In narrow situations, such as certain serious criminal convictions of the at-fault driver or a defective vehicle, a claim outside Enhanced Care may be possible. We will look at your crash and tell you honestly.

Common questions

I was hit by another driver in Victoria. Can I sue them?

For most crashes on or after May 1, 2021, no. BC moved to a no-fault system, so instead of suing you claim benefits through ICBC's Enhanced Care, regardless of who caused the collision. There are narrow exceptions, such as when the at-fault driver is convicted of a serious offence like impaired driving, or when a vehicle defect is involved. We can look at your specific crash and tell you which rules apply to you.

ICBC stopped funding my physiotherapy. What can I do?

A denial or cut-off is not the end of the road. You can ask ICBC to review the decision internally, and if that does not resolve it, the dispute can go to the Civil Resolution Tribunal. The key is medical support and meeting the deadlines. We help you gather the records, frame the request, and present your case so ICBC has to justify its decision.

Do I need to come to your office, or can you help from a distance?

Either works. We have a meeting office in Victoria and also serve Saanich, Langford, and the rest of Vancouver Island. Many clients prefer to start with a phone call for their free case evaluation, and we can handle most of the work remotely. If meeting in person is easier for you, we can arrange that by appointment.
